What Are the Pool Fence Requirements in Wichita, KS?

At least 48 inches tall, no opening a 4 inch sphere can pass, at most 2 inches under it on grass, and gates that open away from the pool and close and latch on their own.

A pool fence in Wichita has to be at least 48 inches tall, measured on the outside. No opening can let a 4 inch sphere through. Over grass, the gap at the bottom can't be more than 2 inches. Gates have to open away from the pool, close on their own and latch on their own. And there can't be rails on the outside a kid can climb. Those rules come from the International Swimming Pool and Spa Code, which Wichita's residential building code points to.

We build fences. We're not code officials. Everything below comes from the sections we link, read in September 2026. MABCD, the building department for Wichita, has the final word, so confirm your plan with them before you build.

Which pool code does Wichita use?

Wichita adopts the Wichita/Sedgwick Unified Building and Trade Code by reference (Wichita Code Sec. 18.15.010). Its residential part adopts the 2018 International Residential Code with local amendments (Ord. 50-833, UBTC Sec. 2.4.010), and MABCD's list of current adopted codes still shows the 2018 IRC (MABCD adopted codes).

That IRC doesn't spell out pool barriers itself. It says "The design and construction of pools and spas shall comply with the International Swimming Pool and Spa Code" (2018 IRC Sec. R326.1). The barrier rules live in Section 305 of the 2018 ISPSC. We didn't find a local amendment to those pool rules in the adopting ordinance. Ask MABCD whether anything else applies to your address.

Do I need a permit for a pool in Wichita?

Almost certainly. The only pools on the local exempt list are "Prefabricated swimming pools that are less than 24 inches (610 mm) deep and the capacity does not exceed 5,000 gallons (18,925 L) in which the pool walls are entirely above ground" (Ord. 50-833, UBTC Sec. 2.4.030). An in-ground pool isn't on it.

An ordinary fence up to 8 feet is exempt from a permit on its own. When it's the barrier for a pool, ask MABCD how they want it handled with the pool permit. Our Wichita fence permit guide has MABCD's contact details and the suburbs that run their own permits.

How tall does a pool fence have to be?

At least 48 inches. The code says the top of the barrier "shall be not less than 48 inches (1219 mm) above grade where measured on the side of the barrier that faces away from the pool or spa" (2018 ISPSC Sec. 305.2.1). That height has to hold around the whole barrier.

The gap at the bottom counts too. Over grass or gravel, it "shall not exceed 2 inches." Over concrete or another solid surface, it can't exceed 4 inches (2018 ISPSC Sec. 305.2.1). Both are measured on the outside.

How far apart can the pickets be?

Openings "shall not allow passage of a 4-inch-diameter (102 mm) sphere" (2018 ISPSC Sec. 305.2.2). Then it depends on the rails.

  • Rails less than 45 inches apart, measured top to top: the rails go on the pool side, and the gaps between pickets can't exceed 1 3/4 inches (Sec. 305.2.5)
  • Rails 45 inches or more apart: the gaps between pickets can't exceed 4 inches (Sec. 305.2.6)
  • Chain link: the mesh opening can't be more than 1 3/4 inches, unless slats bring it down to that (Sec. 305.2.7)
  • A solid fence with no openings can't have indentations or protrusions that make handholds or footholds (Sec. 305.2.3)

The idea behind all of it is simple. A kid shouldn't be able to squeeze through it, crawl under it, or climb it. Close rails on the outside are a ladder, so the code moves them inside. It also wants a clear zone of at least 36 inches between the outside of the barrier and anything a kid could climb, like the pool pump or filter (2018 ISPSC Sec. 305.2.9).

What does a pool gate need?

Pedestrian gates "shall open outward away from the pool or spa, shall be self-closing and shall have a self-latching device" (2018 ISPSC Sec. 305.3). Double gates need one leaf secured in place and the other self-latching (Sec. 305.3.2).

The latch rule gets repeated wrong a lot. The code doesn't say the latch has to be 54 inches up. It says that when the release is less than 54 inches from grade, it has to be on the pool side of the gate, at least 3 inches below the top, and the gate and fence can't have openings over 1/2 inch within 18 inches of it (2018 ISPSC Sec. 305.3.3). So a latch can sit lower than 54 inches if it's built that way.

If a wall of your house is part of the barrier and a door opens straight to the pool, the code has its own requirements for that wall, like listed door alarms (2018 ISPSC Sec. 305.4). That's a question for your pool builder and MABCD, not your fence builder.

Which fence types can meet the pool code?

Most of what we build can, if it's built for it. Ornamental iron is the common pick, because you can see the water through it. It has to be ordered with picket spacing that fits the rail layout above, and tall enough to clear 48 inches with the bottom gap included.

A solid vinyl privacy fence works well, since there are no gaps and the outside face is smooth. A cedar privacy fence works too, built with the rails facing the pool and the smooth picket face on the outside. Pickets set tight leave gaps well under the limits.

Chain link can meet it, but not the standard residential mesh you usually see. It needs the smaller mesh or slats from Sec. 305.2.7. Ask for that by name.

On every pool job, we spec self-closing, self-latching pool gate hardware. Not the drop rod and hasp that's fine on a backyard gate. A pool gate has to swing shut and latch every single time, without anyone thinking about it.

Are there any exceptions to the barrier rules?

One big one. If a swimming pool has a powered safety cover that complies with ASTM F1346, the barrier rules in Sections 305.2 through 305.7 don't apply to the area where it sits (2018 ISPSC Sec. 305.1). Plenty of people still want a fence around the pool. Confirm with MABCD before you count on the cover instead.

Outside Wichita city limits, your suburb may run its own building department. Check the suburb table in our permit guide, and see our fence installation in Wichita page for how a job runs start to finish.

Wichita pool fence questions, answered

How tall does a pool fence have to be in Wichita?

At least 48 inches, measured on the side facing away from the pool (2018 ISPSC Sec. 305.2.1). Wichita's residential code, the 2018 IRC, sends pool rules to the ISPSC (Sec. R326.1).

How big can the gap under a pool fence be?

No more than 2 inches over grass or gravel, and no more than 4 inches over concrete or another solid surface, measured on the outside (2018 ISPSC Sec. 305.2.1).

Which way does a pool gate have to open?

Outward, away from the pool. It also has to be self-closing and self-latching (2018 ISPSC Sec. 305.3).

Can a wood privacy fence be a pool fence?

Yes, if it's at least 48 inches tall, the bottom gap meets code, and it has no handholds or footholds on the outside. Build it with the rails facing the pool when they're less than 45 inches apart (2018 ISPSC Secs. 305.2.3 and 305.2.5).
